Terms of Service

These Terms of Service ("Terms") govern your use of the Imgpressor plugin, API, dashboard, and website (collectively, the "Service"), operated by Adwiz Digital LLP ("we", "us", "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. The Service

Imgpressor is a cloud-based image compression service for WordPress. The plugin installed on your WordPress site communicates with the Imgpressor API to convert images in your media library to AVIF and WebP formats. Compressed files are stored on your own server. The API does not retain copies of your images after processing is complete.

The Service is provided on a credit-based subscription model. One credit = one image compressed (producing both an AVIF and a WebP file).

2. Accounts

• You must provide a valid email address to create an account and receive your API key.
• You are responsible for keeping your API key confidential. Do not share your API key or publish it in public repositories.
• Each API key may be bound to one site URL at a time (Free and Pro plans) or up to five site URLs (Agency plan). Changing the bound domain releases the key from the previous domain.
• You are responsible for all activity that occurs under your API key.
• You must be at least 18 years old to create an account.

3. Plans, Credits, and Billing

• Credits reset on a rolling 30-day basis from the date your plan activated.
• Unused credits do not carry over to the next period.
• When you exhaust your monthly credits, compression stops until your credits reset. No automatic overage billing occurs.
• Credits are non-transferable between accounts.

3.3 Billing

• Paid plans are billed via PayPal on a recurring monthly or annual basis.
• Annual plans are charged as a single lump sum at the start of each annual billing period.
• Subscription renewal happens automatically unless you cancel before the next billing date.
• You are responsible for ensuring your PayPal account remains valid and funded. Failed payments may result in suspension of your paid plan and downgrade to the Free tier.

4. Cancellation

• You may cancel your subscription at any time through your account dashboard or by emailing hi@imgpressor.in.
• Cancellation takes effect at the end of your current billing period. You retain access to your paid plan until that date.
• On cancellation, your account is downgraded to the Free plan. Your API key remains valid, and you may continue to compress up to 300 images per month at no charge.
• We do not delete your compressed images when you cancel. All files stored in your WordPress uploads folder remain untouched.

5. Acceptable Use

You agree not to use the Service to:

• Compress, distribute, or process images that are illegal, infringing, defamatory, or that you do not have the right to use.
• Reverse engineer, decompile, or attempt to extract the source code of the Imgpressor API.
• Resell or sublicense API access to third parties without our written consent.
• Use automated scripts or bots to generate fake accounts or artificially inflate credit usage.
• Attempt to circumvent rate limits, credit enforcement, or domain binding restrictions.
• Use the Service in a way that places an unreasonable load on our infrastructure (e.g. processing thousands of oversized files in rapid succession beyond your plan's intended capacity).

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice depending on the severity of the violation.

6. Your Content

You retain all ownership rights over images you submit for compression. By submitting images to the API, you grant Adwiz Digital LLP a limited, temporary, non-exclusive licence to process those images solely for the purpose of performing the compression service. This licence terminates immediately once the processing is complete and the files are returned to your server.

We do not use your images for training, analysis, advertising, or any purpose other than performing the compression you requested.

You are solely responsible for ensuring you have the right to compress and use any images submitted to the Service. We perform no content filtering and accept no liability for user-submitted content.

7. Service Availability

We aim to maintain high availability of the Imgpressor API but do not guarantee uninterrupted service. The Service is provided "as is" and "as available". We may perform scheduled or emergency maintenance that temporarily affects availability. We will make reasonable efforts to notify users of planned downtime in advance.

We are not liable for any losses arising from service outages, including but not limited to failed compression jobs, missed deadlines, or site performance impacts during downtime.

8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, that compression results will meet your specific quality requirements, or that the Service will be compatible with every third-party plugin or theme.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Adwiz Digital LLP's total aggregate liability to you for any claim arising out of or related to the Service shall not exceed the total fees you have paid to us in the three (3) months immediately preceding the event giving rise to the claim, or USD $50, whichever is greater.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.

Important: You are responsible for maintaining backups of your original image files before using the deletion features of the plugin. We do not store copies of your images and cannot assist with recovery if original files are deleted from your server.

10. Intellectual Property

The Imgpressor WordPress plugin is made available under the GNU General Public License v2 (GPL-2.0) as required for distribution on WordPress.org. This licence applies solely to the plugin code. The Imgpressor API, compression service, brand, and website are the proprietary property of Adwiz Digital LLP LLP and are not covered by this licence.

The Imgpressor name, logo, website design, and API are the property of Adwiz Digital LLP LLP and may not be used without our prior written consent.

11. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms. For minor violations, we will typically provide written notice and a 15-day period to cure the breach before taking action. For serious violations (fraud, abuse, illegal activity), we may terminate immediately without notice.

You may terminate your account at any time by emailing hi@imgpressor.in. Account termination does not entitle you to a refund except as set out in our Refund Policy.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved through good-faith negotiation in the first instance. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
